Salamun'alaikum,


CASE
: A woman is pregant outside of marriage

Today many cases of people getting married at the time the woman was already pregnant. Is the marriage valid? Do they have to be married again after their child was born?

Need saheeh hadith, please...

I read a fatwa long ago that she can marry father of the child during pregnancy .

May Allaah forgive me, I have committed an act of Zina with a Muslim girlfriend which has led to her falling pregnant, I would like to know what steps I have to take in order to gain forgiveness from Allaah saw. Will I be able to marry her as our intention was to get married Inshaa Allaah before this had happened? Would we have to get married straight away or must we wait a certain period? What criteria do we have to meet in order to be together? I understand I have to stay away from her until we have both sought repentance, the only issue is that we work together in the same office, how we would conduct ourselves in this environment. Finally, if we cannot be together what happen during the birth, is it permissible for me to attend the birth? Please could I have a Fatwa as soon as, because I need to take the next logical steps?

Answer







All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.



Adultery and fornication are among the great major sins so you have to sincerely repent. See the details in Fataawa 88158 and 84637.



Marrying the girl is allowed only if both of you truly repent. See the details in our Fataawa 83680 and 84788.



You have to make all efforts to stay away form her and any other woman. If you can change your job or at least your section, to avoid being in contact with this woman, you have to do so.



You do not have any relation with this woman so you can not look at this woman and can not attend the birth.

Inheritance of an illegitimate child

...the child born outside legal wedlock is not traced back to his father, nor does any of them inherit from the other. This is the most preponderant opinion and it is the opinion of the majority of scholars.
Some scholars, however, believe that he can be traced to his father if the latter accepts him as his son. This is the opinion of Is'haq Ibn Rahawahi , Urwa , Sulaiman Ibn Yasar and Abu Hanifa .



Imam Abu Hanifa says: 'I do not find any harm that a man who makes Zina (adultery and fornication) with a woman and she gets pregnant as a result, that this man protects the honor of this woman by marrying her and the child is his' .
