Whole puzzle is one square. Get rid of the top row and very last column to the right, that's second largest square. Don't let the blank space fool you into thinking since it's not a 3x3, it can't be a square.

(smile) We mean the same square. It's the same size as a 3x3, and the top and right of it actually show the 3x3. I wasn't sure how else to describe it, but your way works, too.
