When is it Permissible to Backbite

The ‘ulama have said that there are at least 6 cases in which ghibah (backbiting) is permissible and several of them have gathered these in the following couplets worth memorizing.

الْـقَــدْحُ لَــيْــسَ بِــغِــيبَــةٍ فِي سِتَّةٍ مُـتَــظَــلِّــمٍ وَمُـعَــرِّفٍ وَمُــحَـــذِّر

وَمُجَاهِرٍ فِسْقًا وَمُسْتَفْتٍ وَمَنْ طَلَبَ الإِعَانَةَ فِي إزَالَةِ مُنْكَرِ

يُبَاحُ اغْتِيَابٌ لِلْفَتَى إِنْ تَــجَاْهَرَا بِـفِــسْـقٍ وَلِــلْــتَّــعْــرِيْــ فِ أَوْ لِلْـتَّظَلُّمِ

كَذَاكَ لِتَحْذِيْرٍ وَمَنْ جَاْءَ سَاْئِلً كَذَاْ مَنْ أَتَى يَبْغِيْ زَوَاْلَ الْمُحَرَّمِ

لِــسِــتٍّ غِــيــبَــةً جَـــوِّزْ وَخُــذْهَــا مُــفَــصَّــلَــةً كَــأَمْــثَـــالِ الْــجَــوَاهِــرْ

تَظَلَّمْ وَاسْتَعِنْ وَاسْتَفْتِ حَذِّرْ وَعَرِّفْ وَاذْكُرَنْ فِسْقَ المُجَاهِرْ

The blessed text of Imam al-Nawawi (Allah have mercy on him), Riyad al-Salihin contains a whole chapter dedicated to this issue which he entitled: باب ما يباح من الغيبة: The chapter on that which permits ghibah. In it he mentions six cases in which it is permissible:

اعلم أن الغيبة تباح لغرض صحيح شرعي لا يمكن الوصول إليه إلا بها، وهو بستة أسباب‏:‏

“You should know that backbiting is permissible for specific legislated reasons unreachable except by (way of backbiting) they are the following six reasons:

الأول‏:‏ التظلم، فيجوز للمظلوم أن يتظلم إلى السلطان والقاضي وغيرهما ممن له ولاية أو قدرة على إنصافه من ظالمه، فيقول ظلمني فلان بكذا‏.‏

The first is complaining of oppression, so it is permissible for the oppressed person to present his case to the Muslim ruler or Muslim judge or someone of similar stature and authority to assist in removing the oppression. He can say: “I have been wronged by such and such a person.”

الثاني‏:‏ الاستعانة على تغيير المنكر، ورد العاصي إلى الصواب، فيقول لمن يرجو قدرته على إزالة المنكر‏:‏ فلان يعمل كذا، فازجره عنه ونحو ذلك ويكون مقصوده التوصل إلى إزالة المنكر، فإن لم يقصد ذلك كان حرامًا‏.‏

The second is seeking assistance in changing evil (munkar) and refuting the disobedient until they return to what is correct. So one can say to the one who has the ability to change the evil: “Such and such a person has done this, so advise him.” Or something similar and that he intends to reach this disobedient one by way of removing the evil, so if he intends other than that then it is not permissible.

الثالث‏:‏ الاستفتاء، فيقول للمفتي‏:‏ ظلمني أبي، أو أخي، أو زوجي، أو فلان بكذا فهل له ذلك، وما طريقي في الخلاص منه، وتحصيل حقي، ودفع الظلم‏؟‏ ونحو ذلك، فهذا جائز للحاجة، ولكن الأحوط والأفضل أن يقول‏:‏ ما تقول في رجل أو شخص، أو زوج، كان من أمر كذا‏؟‏ فإنه يحصل به الغرض من غير تعيين ومع ذلك، فالتعيين جائز كما سنذكره في حديث هند إن شاء الله تعالى‏.‏

Thirdly when one seeks fatwa. So he says to the mufti: “My father has oppressed me, or my brother, or my husband, or such and such has done this, does he have right to? And what is the way to sincerity (ikhlas) and obtaining my rights and repelling oppression?” or something along the lines, so this is permissible by necessity. However it is better to say:” What do you say regarding a man, or person, or husband, if his condition is such and such?” So he obtains his purpose without specification, but being specific is permissible, as we will mention in the hadith of Hind, Allah willing.

الرابع‏:‏ تحذير المسلمين من الشر ونصيحتهم، وذلك من وجوه‏:‏ منها جرح المجروحين من الرواة والشهود، وذلك جائز بإجماع المسلمين، بل واجب للحاجة‏.‏

ومنها المشاورة في مصاهرة إنسان، أو مشاركتة، أو إيداعه، أو معاملته، أو غير ذلك، أو مجاورته، ويجب على المشاور أن لا يخفي حاله، بل يذكر المساوئ التي فيه بنية النصيحة‏.‏

ومنها إذا رأى متفقهًا يتردد إلى مبتدع، أو فاسق يأخذ عنه العلم، وخاف أن يتضرر بذلك، فعليه نصيحته ببيان حالة، بشرط أن يقصد النصيحة، وهذا مما يغلط فيه، وقد يحمل المتكلم بذلك الحسد، ويلبس الشيطان عليه ذلك، ويخيل إليه أن
