Hi. I am from Lahore. There is a question I want to ask regarding property. In lahore there are certain plot schemes. In this scheme, you submit an application to real estate. Then there is a balloting which occurs in which all applications of all applicants who have applied are balloted. Successful applicants in balloting are then eligible to buy plots. They have to give money for plot in order to get its possession otherwise there plot is cancelled. Now i want to ask that initially while applying for balloting you have to give some little application fee for processing your application. This processing fee is charged to each applicant for verification and validation of data, sending tcs to office, and updating online platform etc. But after balloting this processing fee is not returned to either successful applicants or to unsuccessful applicants. Now i want to ask that does this comes into gambling? Because I think so application fee is used for processing your application and through this process becomes more secure. And it is not gambling that processing fee is not returned to either successful or unsuccessful applicants. Because plot agency is doing work of processing application and they should be given due fee for that. Just like we have application fee for getting admission is school or university etc. What do you say on this that it is permissible or not permissible?

Is it a publicly owned (government) non-profit scheme or a private for-profit scheme?
Even if it is private - is there a credible threat of malicious competition flooding the administrators with false applications and putting them to loss?
Is a profit made by the administrators through the applications?
Is it more comparable to buying paper, ink, postage stamp, than it is to a gambling lottery scheme.
Are the successful applicants chosen on merit or draw?
If it is a government draw for publicly owned land - is it in order to avoid preferential selection and corruption?

You would need to take many factors into account when deciding whether this is gambling or genuine islaah.

Beware of committing injustice:


وَمِنَ ٱلنَّاسِ مَن يَقُولُ ءَامَنَّا بِٱللَّهِ وَبِٱلْيَوْمِ ٱلْءَاخِرِ وَمَا هُم بِمُؤْمِنِينَ

Of the people there are some who say: "We believe in Allah and the Last Day;" but they do not (really) believe.

يُخَٰدِعُونَ ٱللَّهَ وَٱلَّذِينَ ءَامَنُوا۟ وَمَا يَخْدَعُونَ إِلَّآ أَنفُسَهُمْ وَمَا يَشْعُرُونَ

Fain would they deceive Allah and those who believe, but they only deceive themselves, and realise (it) not!

فِى قُلُوبِهِم مَّرَضٌ فَزَادَهُمُ ٱللَّهُ مَرَضًاۖ وَلَهُمْ عَذَابٌ أَلِيمٌۢ بِمَا كَانُوا۟ يَكْذِبُونَ

In their hearts is a disease; and Allah has increased their disease: And for them is a grievous penalty because they are false.

وَإِذَا قِيلَ لَهُمْ لَا تُفْسِدُوا۟ فِى ٱلْأَرْضِ قَالُوٓا۟ إِنَّمَا نَحْنُ
مُصْلِحُونَ

When it is said to them: "Make not mischief on the earth," they say: "Why, we are only those who set things right!"

أَلَآ إِنَّهُمْ هُمُ ٱلْمُفْسِدُونَ وَلَٰكِن لَّا يَشْعُرُونَ

Of a surety, they are the ones who make mischief, but they do not bring this to mind.

Answer: It’s a private real estate scheme. Real state owners gets profit by selling plots to customers. Customers are selected on the basis of draw. Only those customers whose name comes in draw are eligible to buy plots. They have to submit money of plot to get it. But if they do not buy plots within given date, then they are rejected. Then that vacant plot goes to some other customer.

Even if it is private - is there a credible threat of malicious competition flooding the administrators with false applications and putting them to loss?
Answer: All applications have equal number of chances.

Is a profit made by the administrators through the applications?
Answer: That I can not say for sure. But on their website they have written that they are charging application fee to all applicants. But there main source of profit is constructing plots and giving to successful applicants who have paid plot payment after their name comes in draw.

Is it more comparable to buying paper, ink, postage stamp, than it is to a gambling lottery scheme.
Answer: We have to buy plots if our application comes successful in draw.

Are the successful applicants chosen on merit or draw?
Answer: Successful applicants are chosen on draw. Merit is that you have to submit application and its processing fee till the last day. Otherwise your application is rejected.

If it is a government draw for publicly owned land - is it in order to avoid preferential selection and corruption?
Answer: It’s a private owned land. But real estate has to get NOC from government to acquire land to construct plots.
