Sunnah/voluntary prayer while the Iqaamah is called

Question: What is the ruling of the one who starts to pray the Sunnah prayer before the prescribed prayer and while he is in prayer the Iqaamah for the prayer is called, does he break off from the prayer and join the obligatory prayer because of the Hadeeth:

“When the Iqaamah for the prayer is called there is no prayer except the prescribed prayer.”

Furthermore, how does he break off from his prayer? Is it by making Tasleem or does he sever the intention of prayer without making Tasleem? And what is the ruling of the statement of the one who says he is to hurry in his prayer and make it short, and he uses His (سبحانه وتعالى) statement as a proof:


وَلا تُبْطِلُوا أَعْمَالَكُمْ

And do not nullify your deeds.” - Muhammad (47):33
Furthermore, this hurrying does not infringe the validity of the prayer.

Answer: What is correct from the statements of the people of knowledge is that he leaves his prayer when the Iqaamah for the prayer is called as is in Saheeh Muslim from the Hadeeth of Abu Hurairah (رضي الله عنه):

“When the Iqaamah for the prayer is called there is no prayer except the prescribed prayer.”

As for His (سبحانه وتعالى) statement:


وَلا تُبْطِلُوا أَعْمَالَكُمْ

“And do not nullify your deeds.” - Muhammad (47):33

What is intended is: Do not commit from the sins and evil deeds or Shirk that which nullify your deeds, or Riyaa (showing off) that which nullify your deeds. It does not mean that you have nullified your deed when you follow the Hadeeth of the Messenger of Allaah (صلى الله عليه وعلى اله وسلم). And that which is apparent to me is that if he is in the Tashahhud and he is able to finish before the ranks are straightened, because straightening the ranks is something desired, there is no harm in that. As for Abu Muhammad ibn Hazm (رحمه الله), he says that he is to leave it even if he is in the Tashahhud. Furthermore, he leaves it and it is not necessary that he make Tasleem, rather, he follows the Hadeeth:

“When the Iqaamah for the prayer is called there is no prayer except the prescribed prayer.”

And he is upon his intention and I hope that Allaah records it for him (in his favor).

“Verily the deeds are only considered with the intentions, and for each person is what he intended.”

As for, if making the Tasleem is incumbent upon him or is it something not legislated for him, that which is apparent is that it is not legislated for him.
