Need some help:omg:imagine if a girl got married to a guy and because of some problems she ran away from him, she didnt quite get a proper divorce but then married another guy (who had to get a divorce from his wife to marry her) is that marriage valid? Also she has a kid:anger:,he has 4, but islamically should she take custudy of the kid or should his dad take him?:uhwhat

So they both were married before, and left their husband/ wife without a divorce and got married to each other.

And you wanna know if their marrige is valid?

Asalamu alaikum,
I'm sorry the marriage is not legally and Islamically valid because she did not get divorced before she remarried. I'm sure her reasons were valid, but without a proper divorce she may not be able to get custody of her kids. She should consult a lawyer/

Im not them:zip: the guy did get a divorce, but the girl didn't. The previous guy she was married to is planning to take custudy of the child he had with her, but the thing is when she ran away she was away from him for a while i doubt the child remembers him or his family.

the girl has to get a divorce in the eyes of Allah...dnt think the eyes of the law are too important here.custody of the kid can be with either parent.but she still holds motherly rights on the kids...she will be questioned in the hereafter for neglecting them if she does.
