Is this riba?

    Is this riba?

    When someone borrowed money from you, a Muslim, with no Riba or interest, and when he returned it to you, let's say, he is a Christian, he voluntary just added more for being grateful to you for lending money. Would taking it be considered riba? The definition of riba in Google is: Unjustified increment in borrowing or lending money. Does the example entail that it is justified when the borrower himself voluntarily, with his will, as a thanks for lending him money, added more payment to the lender? Thank you in advance.

    It is not riba as long as there is no expectation to receive increase from any other than Allah on the part of the lender.

    The lender lends with Allah in mind.
    The best is one who returns with generousity.



    It was narrated from Abu Rafi' that:
    the Prophet (ﷺ) asked a man to give as a loan a young camel and said: “When the camels of the Sadaqah come, we will pay you back.” When the camels came, he said: " O Abu Rafi', pay this man back for his Young camel." But all I could find was a seven-year-old camel or that which is better. I told the Prophet (ﷺ) and he said: "Give it to him, for the best of People are those who are best in repaying."

    حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا مُسْلِمُ بْنُ خَالِدٍ، حَدَّثَنَا زَيْدُ بْنُ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ، أَنَّ النَّبِيَّ ـ صلى الله عليه وسلم ـ اسْتَسْلَفَ مِنْ رَجُلٍ بَكْرًا وَقَالَ ‏"‏ إِذَا جَاءَتْ إِبِلُ الصَّدَقَةِ قَضَيْنَاكَ ‏"‏ ‏.‏ فَلَمَّا قَدِمَتْ قَالَ ‏"‏ يَا أَبَا رَافِعٍ اقْضِ هَذَا الرَّجُلَ بَكْرَهُ ‏"‏ ‏.‏ فَلَمْ أَجِدْ إِلاَّ رَبَاعِيًا فَصَاعِدًا فَأَخْبَرْتُ النَّبِيَّ ـ صلى الله عليه وسلم ـ فَقَالَ ‏"‏ أَعْطِهِ فَإِنَّ خَيْرَ النَّاسِ أَحْسَنُهُمْ قَضَاءً ‏"‏ ‏.‏

    باب مَا جَاءَ فِي اسْتِقْرَاضِ الْبَعِيرِ أَوِ الشَّىْءِ مِنَ الْحَيَوَانِ أَوِ السِّنِّ
    Narrated Abu Hurairah:

    "The Messenger of Allah (ﷺ) took a camel of a particular age on loan. He gave back to him a camel of a better age than the one he was given. He said: 'The best among you is the best in repaying.'"

    He said: There is something on this topic from Abu Rafi'.

    [Abu 'Eisa said:] The Hadith of Abu Hurairah is a Hasan Sahih Hadith. Shu'bah and Sufyan reported it from Salamah.

    This is acted upon according to some of the people of knowledge, they saw no harm is taking a camel of a particular age as a loan. This is the view of Ash-Shafi'i, Ahmad, and Ishaq. But some of them disliked that.

    حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا وَكِيعٌ، عَنْ عَلِيِّ بْنِ صَالِحٍ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ اسْتَقْرَضَ رَسُولُ اللَّهِ صلى الله عليه وسلم سِنًّا فَأَعْطَاهُ سِنًّا خَيْرًا مِنْ سِنِّهِ وَقَالَ ‏ "‏ خِيَارُكُمْ أَحَاسِنُكُمْ قَضَاءً ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ أَبِي رَافِعٍ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَقَدْ رَوَاهُ شُعْبَةُ وَسُفْيَانُ عَنْ سَلَمَةَ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ لَمْ يَرَوْا بِاسْتِقْرَاضِ السِّنِّ بَأْسًا مِنَ الإِبِلِ ‏.‏ وَهُوَ قَوْلُ الشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ ‏.‏ وَكَرِهَ بَعْضُهُمْ ذَلِكَ ‏.‏

    The Book of Jihad
    Abu Hurairah (May Allah be pleased with him) reported:
    A man demanded of the Prophet (ﷺ) for repayment of a loan and was harsh to him. His Companions were about to attack him, but he (ﷺ) said, "Leave him, as the creditor is entitled to make a demand. Give him a camel of the same age as the camel that is due to him." They said: "We find a better camel senior to it in age." He (ﷺ) said, "Then buy it and give it to him; verily the best of you is the one who is the best in discharging his obligations (repayment of loans)."

    [Al- Bukhari and Muslim].

    وعن أبي هريرة رضي الله عنه أن رجلا أتى النبي صلى الله عليه وسلم يتقاضاه فأغلظ له فهم به أصحابه، فقال رسول الله صلى الله عليه وسلم ‏:‏ ‏"‏دعوه فإن لصاحب الحق مقالا‏"‏ ثم قال‏:‏ ‏"‏أعطوه سنا مثل سنه‏"‏ قالوا‏:‏ يا رسول الله لا نجد إلا أمثل من سنه، قال‏:‏ ‏"‏أعطوه فإن خيركم أحسنكم قضاء‏"‏ ‏(‏‏(‏متفق عليه‏)‏‏)‏ ‏.‏
