    as-Salamu alaikum wa rahmatullahi wa barakatuhu:

    On behalf of the Dr. Ali Al-Timimi Support Committee
    we are asking all concerned Muslims to increase in
    their prayers for their brother Ali. <SNIP>

    On July 13, 2005 - if everything remains as scheduled
    - Ali will appear at 10 am before Judge Brinkema for
    sentencing.

    At that time, one of four matters can happen:

    1. She can accept the Defense motion and declare Ali
    innocent on all ten counts based on his Constitutional
    rights of freedom of speech and religion.

    2. She can accept the Defense motion for a new trial
    based on prosecutorial misconduct. <SNIP>

    3. She can accept the jury's verdict and sentence Ali
    to life in prison.

    4. She can pick and choose which counts to sentence
    Ali on and sentence Ali as follows:

    - Count 1 Inducing others to conspire to use weapons
    - Up to twenty years - court's recommendation is
    151-188 months (twelve years, seven months to fifteen
    years, eight months)

    - Count 2 Soliciting others to levy war against
    America - Up to twenty years - court's recommendation
    is 151-188 months (twelve years, seven months to
    fifteen years, eight months)

    - Count 3 Inducing others to conspire to levy war
    against America - Up to twenty years - court's
    recommendation is 151-188 months (twelve years,
    seven months to fifteen years, eight months)

    - Count 4 Attempting to aid the Taliban - Up to
    ten years - court's recommendation is 120 months
    (ten years)

    - Count 5 Inducing others to conspire to aid the
    Taliban - Up to ten years - court's recommendation
    is 120 months (ten years)

    - Count 6 Conspiring to levy war against Israel,
    Russia and India - Up to five years - court's
    recommendation is 60 months (five years)

    - Count 7 inducing others to use firearms -
    mandatory 30 years with no parole

    - Count 8 Inducing others to use firearms -
    mandatory life with no parole

    - Count 9 Inducing others to carry explosives -
    mandatory 10 years with no parole

    - Count 10 Inducing others to carry explosives -
    mandatory 20 years with no parole

    In addition the court has recommended a fine of a
    quarter million dollars.

    The government has objected that these punishments are
    too light and have asked the Judge to sentence Ali to
    six consecutive life sentences plus an additonal 1,110
    (that's one thousand one hundred and ten) years plus a
    fine of three million dollars as they consider him the
    most dangerous man in America this is based on the
    government's belief which was said to Ali once, "You
    might not be Malcom X, but you will bring the next
    Malcom X to America."

    Ali and his defence team have done all that they can
    do at this time from worldly means. What is needed is
    Allah to be merciful with Ali and allow to be saved
    from this test unscathed. Please pray and seek those
    times when prayers are answered (the last third of
    the night, jumua, after the adhan, when it is raining).

    Please pass this message on and ask as many Muslims
    you know to make du'aa.

    The hearing will be at 10 am on Wednesday July 13,

    Dr. Al-Timimi’s Statement in Court after the judge denied his motions.

    All praise is due to God and may God’s blessings and peace be upon all his prophets – particularly Noah, Abraham, Moses, Jesus and Muhammad.



    Your honor, it is customary at the time of sentencing that those found guilty give a statement during which they admit their guilt and thereupon entreat the court to show them leniency.



    I stand before this court having been found guilty of ten felonies. However, I will not admit guilt nor seek the Court’s mercy. I do this not out of any disrespect to the Court. I do this simply because I am innocent.



    My claim of innocence is not because of any inherent misunderstanding on my part as to the nature of the crimes for which I was convicted nor is it because my Muslim belief recognizes sharia rather than secular law. It is merely because I am innocent.



    Few in the history of this country have been charged with what I was charged. None I believe have ever been so removed from the charges.



    My experience is therefore unique and is thus worthy of some comment and reflection.



    During its closing argument the Government read to the jury the preamble to the Constitution. I frankly found it to be a poor recitation. I will not be in any need of paper to recite those words for I faithfully committed them to memory as a schoolboy long before I was taught or learnt any passage of the Koran.



    We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquillity, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.



    I declare the government’s recitation poor as it stripped those words of their meaning. Allow me to explain why. The first aim of the Constitution after the immediate raison d’etre – of forming a more perfect Union – is to establish justice. The establishment of justice was mentioned before the aim of providing for the common defence. Common defense is what we today call security. The reason as to why justice proceeded security should be obvious to all: true security can never been attained without true justice.



    I, as many of my community since 9/11, have been denied justice.



    I am not a lawyer so I am unable to cite case law to demonstrate this. I will instead have to appeal to the very philosophy upon which the law is based. Aristotle teaches us that justice means to equate similar things and distinguish between dissimilar things.



    Let us recall the crimes to which I was charged: advocating treason, soliciting war against the United States, providing aid and comfort to the enemy, conspiring to levy war against Israel, Russia, India, and Indonesia, and of course at every turn the informal charge of terrorism.



    Charges I must say “abounding in crudities and absurdities.”[1]



    For to accept these charges we must believe that a solitary man who would spend his days working full time at one of Fortune magazine’s one hundred best companies[2] and then spend his evenings and weekends engaged in cancer research for a doctorate in computational biology; an individual who never owned or used a gun, never traveled to a military camp, never set foot in a country in which a war was taking place, never raised money for any violent organization would be – could be – the author of so much harm.



    “Crudities and absurdities” your honor …



    Someone who did not observe the proceedings might justifiably ask: How then was he convicted? The answer, of course, was simply out of fear.



    The eminent jurist Stephen L. Carter cautions:



    When the secular sovereign decides to try a citizen on a charge that amounts to serving a separate sovereign, the jury should be pressed toward the sobriety of democratic respect rather than the intoxicating fury of the witch-hunt.[3]



    If this is his admonition for a charge that “amounts” to serving a separate sovereign, how much more so should it be when the charge is the actual raising of arms against the sovereign!



    It is said that historically two trials have captured the imagination of Western civilization. The trial of Jesus Christ[4] and that of Socrates.



    Rome was a brutal empire. Athens was a democracy.[5] Plato relates to us that during his trial Socrates said the following:



    They – in reference to the prosecutors – are headed by Meletus, that good man and true lover of his country, as he calls himself. Against these, too, I must try to make a defense:, Let their affidavit be read: it contains something of this kind: It says that Socrates is a doer of evil, who corrupts the youth; and who does not believe in the gods of the state, but has other new divinities of his own. Such is the charge; and now let us examine the particular counts. He says that I am a doer of evil, and corrupt the youth; but I say, O men of Athens, that Meletus is a doer of evil, in that he pretends to be in earnest when he is only in jest, and is so eager to bring men to trial from a pretended zeal and interest about matters in which he really never had the smallest interest.[6]



    In the coming months this courthouse will witness the trial of another individual accused of betraying his country.[7] Let us wait and see if the Government’s zealotry to prosecute that case will be as was with mine.



    In the end, I too like Socrates am accused and found guilty of nothing more than corrupting the youth and practicing a different religion that of the majority. Socrates was mercifully given a cup of hemlock, I was handed a life sentence.



    Imprisonment of any term, as this Court well knows, is a crisis for the incarcerated and his or her loved ones. I am no exception to that.



    But the real crisis brought on my imprisonment, I sincerely believe is America’s. For if my conviction is to stand, it would mean that two hundred and thirty years of America’s tradition of protecting the individual from the tyrannies and whims of the sovereign will have come to an end. And that which is exploited today to persecute a single member of a minority will most assuredly come back to haunt the majority tomorrow.

    True, may Allah subhana Tala, make it easy for him, i dont know if any of u have heard a speach he made, but he has the most significant amount of Sabr and acceptance that Allah knows best and it provides inspiration for onesself, of how much trial and tribulation there is in life. May Allah give us all the ability to have sabr and look up to those in worse of a position then ourselves.

    watever Allah swt decrees for somone nobody can deny it. may Allah have mercy on brother Ali Timimi and let him stay steadfast on deen. And dont forget people that a da'ee of islam is a da'ee werever they go, and if Allah has used the brother as the means of guidance for the prosoners than we cannot be anything but content and say Alhamdulillah. Now that something like this has happend, we as muslims cannot let it go by like nothing. we should use this example to let people kno the injustice done to muslims all around the western world and give da'wah to preach the true islam reveal to Rasulullah saw from Allah

    Inshallah justice will be served in the court of Allah swt and our brother in islam will get Jannah in return for his hardships for the sake of Allah. Jazakallahukhair and may Allah azza wa jal guide all of us and make us the means of guidance for many people.

    glory be to Allah who has chosen us for Islam. when i first read about br. tamimi's sentence i was deeply saddened, shocked and amazed. i was saddened, not because of any discontent with the decree of Allah, but because of the great injustice that is once again being meeted out to muslims under the false banner of justice. i was shocked and amazed because of the harshness of the sentence given for making statements that displeased the american government. that is odd, considering that fact that hate groups such as the kkk and neo-nazis are allowed to publicly spew their venom against supposed inferior races. they do this publicy and the u.s government allows them to incite hated and fear, is that not terrorism. the history of these groups is well known, but instead of the government shutting them down or silencing them in the same fashion they did br. tamimi, they allow them to operate. And what is wrong with you that you fight not in the Cause of Allah, and for those weak, ill-treated and oppressed among men, women, and children, whose cry is: "Our Lord! Rescue us from this town whose people are oppressors; and raise for us from You one who will protect, and raise for us from You one who will help." ( 4:75 ) may Allah reward br. tamimi for his patience.

    Only a person with a heart infested with hypocrisy and hatred towards Muslims could say that. Allah guided Brother Ali away from the fake 'Salafis' and he exposed them for what they really are ie. followers of their desires who pick and choose what is according to that. For you to say what you have said about a Brother who has been imprisoned for life is sickening - may Allah --- guide you to the real salafiyyah.

    For those with an open heart free from desires here is Brother Ali Timimi's Advice to the UK Salafis .

    May Allah hasten his release and break the mouths of those who slander and insult him. Ameen.
