..Eighteen Year-old Muslimah In Prison for Killing Rapist
An 18 year-old in America has been charged of murder and is being held
in a jail in Atlantic City, New Jersey.
Hala Gabr, was just 17 and three weeks of turning 18, when her foster
mother took her to Atlantic City, while she went into a casino. Hala
was left by herself to see the sights. After a while, Hala called a
cab to go back and meet up with her foster mother.
The cab driver offered her $20. to have sex with her. When Hala
refused, the cab driver pulled a knife on her and forced to a motel
room where he raped her violently. Medical records proved that she was
sexually violated. At some point during the whole ordeal, she hit the
cab driver with a bottle and knocked him to the ground. As he went
down, she reached for the knife and stabbed him 13 times.
She hid his body in the bed under the mattress, cleaned up the room,
drove off in his car and threw all of his belongings in a nearby
stream. These items have been found, negating the prosecution's claim
that she was stealing his belongings.
Because she was so shocked by the whole incident, she got into a car
accident, and was taken unconscious to a hospital. When she was
revived, she fled to her father's house in Brooklyn (from where she
originally escaped from abuse and thus put into a foster home). The
police found her purse in the car and traced her there, where she was
arrested.
The rapist, authorities said, frequently picked up prostitutes and was
known as a sxual predator in the Atlantic City area.
Hala does not have a criminal record, and although she cannot get the
death penalty because of her age at the time, she is subject to life
without parole for 50 years. She is currently being held on $500,000
dollars bail.

I agree and disagree. I agree that the 13 stabbings are... suspect, and will definitely not work in her favour. They're also far beyond the defence of self-defence. Her state of mind would help in mitigation (i.e. they might 'soften the blow' of a sentence), but the fact that she stabbed the guy 13 times is a very hard fact to justify. At best she might be able to plead insanity on the grounds of diminished responsibility (since she suffered a sudden and temporary loss of self-control), but it's extremely doubtful she could plead self-defence.
I disagree that she killed him in hatred, since I don't know what she was thinking. However, a jury may very well see this as evidence of malice aforethought.

from wa the rapist did.. its well obvious that her mind was soo confused and she was afraid - she was really angry and scared and because of that you have alot of adrenaline inside of u.. she wanted to escape without no-one noticing and so she would have enough time without getting any attention which lead to her hiding the body..
erytime i remember it i think - her foster mother went to gamble and therefore maybe her parenting wasnt right which might lead to her getting to know muslim sisters in prison - which might lead to her having more faith insha Allah. this happens to alot of brothers and sisters and thats why they alot of reverts in prison.. but then i think about it and its a 50years sentence..
so i think we should just pray that Allah (swt) guides us all.. and pray for what is for the best for all the muslim ummah. insha Allah she could get a early release and be a better practisin muslim than b4.. insha Allah. may Allah (swt) guide us all and grant us all jannah al firdaus - ameen.
so lets just have faith in Allah (swt) and pray cz thats all we can do right now.. remember - alot of your prayers get answered in ramadhan. barak Allah u feekum.
I agree it si very sad that nowadays muslims are being treated
harsher. The kuffars just want a reason to put muslims behind
bars in the name of "JUSTICE". But we should not be afraid as
Allah promised us victory.
i dont think they would allow it.. most of the time they just want any excuse to give muslims a bad name and cause them distress.. this way it causes more pressure on the muslims and makes them feel helpless.. this is one of the main reasons we shouldn't even live in a kafir dominated society esp. where there are kufar leaders in power:

but at the end of the day the rapist got what he deserved which he probably wouldnt if he was tried under the law of America. unfortunately one of our innocent sisters has to suffer too....
i dont agree with you akhi.. shes your sister and if you come to reality - she shouldn't. and even if you say she should get punished - a person gets life for murdering someone and that equals 25years. now how come shes getting 50years for it? second - she got assaulted really violently and if that doesn't make you angry (remember shes your own sister) then i dno what will.. and they never still put the amount of years lower [due to her being assaulted], and my last point is - she was in a mode of distress where she couldn't think straight and therefore the penalty should drop lower from that too. why is her bail so high? is $500,000 really the price for murder bail?
i dont understand how you agree with laws like this.. is this really equality?

ok if this happened in a country like saudi, what do you think they would have done to the sister? she stabbed a man multiple times and they can't do anything to the man because he is dead

akhi the guy who would do that would get death anyway - yeh she did stab the guy multiple times but this was probably due to the distress which she was in, she was desperate to escape so the guy wouldn't get back up. you take alot of considerations including what he did to her and how that affected her mentally aswell as physically which lead to the increase of fear and adrenaline. seriosly put yourself in the situation of the sister but if you cant do that then at least imagine the sister being your first sister..
and if the sister was in arabia - she might have got a lighter punishment due to the punishment of the rapist being high. but in the kufar countries - the punishment of rape is really light and they dont even care if someone gets raped whereas in islamic law its a really important and dangerous matter.

Murder sentences are served concurrently (at the same time). She'll be entitled for parole if she's well-behaved, which I think is likely inshallah.

A lot of people kill in anger or some other strong emotion. Though I may or may not agree with the motives, it does not change the fact that a crime has been comitted. It's like if a guy steals to feed his family, though I agree with the motives, he's still technically a thief.

We have to abide by the laws of the land we live in, whether we agree with them or not.
