Early Nikkah so it be Halal!

    Early Nikkah so it be Halal!

    Salaamu Alaykum WaRahamtulahi WaBarakatu Brothers and Sister!

    A sister and potential husband want to get a Nikkah but they havnt known eachother long enough for family to accept.They are both content and feel that they connected very early and feel that they dont need to "talk" for any longer. Many people in the west feel that they have to know someone for years and they talk for a long time without a Mahram present ect..

    The sister now speaks to him via email where she allows he brother to view which every emails he wishes. Is this a valid way of having a mahram present?

    Also they want the Nikkah this year but the sister has 2 years of nursing school let and she must finish.He will be working in the Middle East.They know it will be hard but they know they have to keep it halal so Nikkah is the only option,

    The marriage wont be consummated until after she finishes school.So the questions are:

    1. Does the Nikkah become nullified if the marriage isnt consummated in a certain time frame (2 years)

    2. Does the marriage have to be announced at the time of the Nikkah or can it be done when they ready to move in together (2 years).

    3.Can the Walimah be done 2 years after the actual Nikkha?

    Jazakallahu khayr. I could understand non Muslims believing that one has to get to know a potential partner for a long time before marrying them but what i don't understand is why certain "Muslim" parents would think in such a way? A person does not have to get to know a potential partner for such a long time until they decide whether they want to take things further or not. It certainly is not in Islam for a person to delay marriage or prolong it unnecesserily especially as doing such a thing may cause passions to ignite in the couple hence causing them to ed up falling for each other and eventually committing haraam.

    The whole purpose of marriage in Islam is to avoid such a situation from occuring by fulfilling ones desires in a legitamate manner and creating a bond and love from the beginning of marriage and letting it grow throughout. Therefore as soon as one realises that they want to spend the rest of their life with the person then they should marry immediately and not delay. So you should certainly have a discussion with your parents about this and let her have a proper discussion with hers, and you should push the fact using wisdom and tact that you want to get married as soon as possible because that is what is emphasised in Islam.

    Regarding your questions then consumation of the marriage and Walima should not be delayed unnecesserily after the Nikah. It is more important for consumation to take place quicker than it is to do Walima quicker. A cholar mentioned that consummating the marriage within a certain amount of time is not a requirement for the validity of the nikah. Therefore the marriage will not be void if consummation does not take place.

    But you should take into account both of your desires and it is something which is personal between the both of you but consumation should certainly not be delayed after the nikah and you do not have to wait for the ruksathee or walima in order to consumate the marriage. There is no particular time limit for consumation or for how long the walima has to be after nikah etc but it should not be delayed unnecesserily and it should certainly not be delayed because of having to save up for a huge venue etc.
