Dunno if this is already Asked?

But I have a question About Ayah 3 Of Surah 24 Nur

It says :

"The fornicator shall not marry any but a fornicatress or idolatress, and (as for) the fornicatress,
none shall marry her but a fornicator or an idolater; and it is forbidden to the believers."


So What Happens If a believer marries a Woman But Later in the Marriage Says That She Commited Fornication ?
and How can Someone Know That He or She Comitted Fornication?

Is it true that a righteous man does not marry anyone other than a righteous woman?


Question:

I have herd from brothers that one gets a parteners (ie wife for men and husband for women) which one deserves,.If one is good he/she will get a pios partener unless it is a test from ALLAH. Unfortunattely i have not come across any hadith on this subject and could you please give me references and advice on this topic so that i can advice the brothere and sisters I Have also been told that if a man does zina it will result in him being punishede by some female member of his family doing zina. Is this true ?
Many young muslims go about looking for a partener in the haram way .should i tell them that if they are pios they will definnalely get someones who is equally pios unless they are being tested by ALLAH?
because if this is true it may deter many a muslim from commiting haram and it may even make them more entuisianstic about becoming beter muslims.

Answer:

Praise be to Allaah.

What you have heard, that a man marries the person he deserves and who is similar to him in terms of righteousness or immorality is not correct. This is indicated by the following:

1 – The story that Allaah tells us of two of His noble Prophets, namely Nooh and Loot (peace be upon them), whose wives were disbelievers. Allaah says (interpretation of the meaning):

“Allaah sets forth an example for those who disbelieve: the wife of Nooh (Noah) and the wife of Loot (Lot). They were under two of our righteous slaves, but they both betrayed them (their husbands by rejecting their doctrine). So they [Nooh (Noah) and Loot (Lot)] availed them (their respective wives) not against Allaah and it was said: ‘Enter the Fire along with those who enter!’”

[al-Tahreem 66:10]

2 – Islam does not allow an adulterer to marry a chaste woman, and it does not allow a chaste man to marry an adulteress. This indicates that such a thing could happen, and indeed it happens often.

Allaah says (interpretation of the meaning):

“The adulterer — fornicator marries not but an adulteress — fornicatress or a Mushrikah; and the adulteress –fornicatress, none marries her except an adulterer — fornicater or a Mushrik [and that means that the man who agrees to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan or idolatress) or a prostitute, then surely, he is either an adulterer — fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer — fornicator, then she is either a prostitute or a Mushrikah (female polytheist, pagan, or idolatress)]. Such a thing is forbidden to the believers (of Islamic Monotheism)”

[al-Noor 24:3]

3 – The Prophet (peace and blessings of Allaah be upon him) said that a woman may be married for her wealth, her beauty, her lineage or her religious commitment, and the fact that he (peace and blessings of Allaah be upon him) encouraged marrying the one who is religiously-committed indicates that marriages could occur for other reasons, so a man might marry a woman who is not like him.

It was narrated from Abu Hurayrah that the Prophet (peace and blessings of Allaah be upon him) said: “Woman are married for four things: for their wealth, their lineage, their beauty and their religious commitment. Marry the one who is religiously-committed, may your hands be rubbed with dust (i.e., may you prosper).”

(Narrated by al-Bukhaari, 4802; Muslim, 1466).

4 – The fact that the Prophet (peace and blessings of Allaah be upon him) commanded guardians to marry the women under their care to religiously-committed men indicates that something other than that could happen.

It was narrated that Abu Hurayrah said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “If there comes to you one with whose religious commitment and character you are pleased, then marry (your daughter or other female relative under your care) to him, for if you do not do that there will be tribulation in the land and much corruption.”

Narrated by al-Tirmidhi, 1084; Ibn Maajah, 1967. Classed as saheeh by al-Albaani in al-Silsilah al-Saheehah, 1022.

So the one who is looking for a wife should look for one who is religiously-committed and has a good character; similarly, woman’s guardians should not marry them to anyone but those who are religiously-committed. For a man is influenced by those with whom he keeps company, especially if that lasts for a long time. The Prophet (peace and blessings of Allaah be upon him) said: “A man will follow the way of his close friend, so let each of you look at whom he takes as a close friend.” (Narrated by al-Tirmidhi, 2378; classed as hasan by al-Albaani in Saheeh al-Tirmidhi, 1937).

“A man will follow the way of his close friend” i.e., he will follow the habits and path of his friends; “So let each of you look” means, think long and hard about; “whom he takes as a close friend” means, whom he regards as a friend and a brother. So if you like a person’s religious commitment and character, take him as a close friend, and if not, then avoid him. For characteristics are easily copied and keeping company with people has an effect on whether you will be good or bad. Al-Ghazaali said: Sitting with and mixing with one whose interest is worldly gain will make you also seek worldly gains; sitting with and mixing with one who is an ascetic will make you care little for worldly gains, because following characteristics are easily copied and one could copy the characteristics of one's friend without even realizing.

Secondly:

With regard to the adulterer, he may be punished with regard to his family. A hadeeth to that effect was narrated, but it is mawdoo’ (fabricated), however the meaning may be correct. We have mentioned it, with comment, in question no. 22769.

Is it permissible for one who has committed zina (fornication or adultery) to get married after he or she has repented?


Question:

I am a muslim that converted about three years ago. I am still learning and I have a question. I have been told that if I had sex after I converted I would not be able to islamically get married under the ways of islam. I wanted to know if this is true and if it is, is there any way to correct the deed that I am so very sorry for.

Answer:

Praise be to Allaah.

The one who has committed zina (fornication or adultery) has to repent, because zina is one of the major sins which are forbidden in Islam and for which a stern warning is issued to the one who does them. Allaah says (interpretation of the meaning):

“And those who invoke not any other ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit illegal sexual intercourse and whoever does this shall receive the punishment.

The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace”

[al-Furqaan 25:68-69]

The punishment must be carried out in this world on the one who has committed zina (fornication or adultery), as Allaah says (interpretation of the meaning):

“The fornicatress and the fornicator, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by Allaah, if you believe in Allaah and the Last Day. And let a party of the believers witness their punishment”

[al-Noor 24:2]

It was narrated in a hadeeth from the Prophet (peace and blessings of Allaah be upon him): “Receive (teaching) from me, receive (teaching) from me. Allaah has ordained a way for those (women). When an unmarried male commits adultery with an unmarried female, (they should receive) one hundred lashes and banishment for one year. And in the case of a married male committing adultery with a married female, they shall receive one hundred lashes and be stoned to death.”

(Narrated by Muslim, al-Hudood, 3199).

Allaah has forbidden the believers to marry a person who commits zina, whether man or woman. Allaah says (interpretation of the meaning):

“The adulterer — fornicator marries not but an adulteress — fornicatress or a Mushrikah; and the adulteress –fornicatress, none marries her except an adulterer — fornicater or a Mushrik [and that means that the man who agrees to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan or idolatress) or a prostitute, then surely, he is either an adulterer — fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer — fornicator, then she is either a prostitute or a Mushrikah (female polytheist, pagan, or idolatress)]. Such a thing is forbidden to the believers (of Islamic Monotheism)”

[al-Noor 24:3]

If the one who has committed zina repents to Allaah, truly and sincerely, then Allaah will forgive him or her, and overlook the sin. Allaah says, after mentioning the warning to those who commit zina:

“Except those who repent and believe (in Islamic Monotheism), and do righteous deeds; for those, Allaah will change their sins into good deeds, and Allaah is Oft Forgiving, Most Merciful.

And whosoever repents and does righteous good deeds; then verily, he repents towards Allaah with true repentance”

[al-Furqaan 25:70-71 – interpretation of the meaning]

If the person repents sincerely, then it becomes permissible for him or her to get married, after they give up this sin.

Shaykh Muhammad ibn Ibraaheem was asked about the ruling on getting married to a woman who has committed zina. He said: “it is not permissible to marry the woman who has committed adultery until she repents… if a man wants to marry her, he has to be sure that she is not pregnant, by waiting until she has a period before he does the marriage contract with her. If she is pregnant, then it is not permissible for him to marry her until she has given birth.”

Is it permissible to marry a woman who used to commit zina?.

Answer:


Praise be to Allaah.

It is not permissible to marry a zaaniyah or zaani unless they have repented. If the man or woman has not repented then the marriage is not valid.

Allaah says (interpretation of the meaning):

“The adulterer — fornicator marries not but an adulteress — fornicatress or a Mushrikah; and the adulteress –fornicatress, none marries her except an adulterer — fornicater or a Mushrik [and that means that the man who agrees to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan or idolatress) or a prostitute, then surely, he is either an adulterer — fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer — fornicator, then she is either a prostitute or a Mushrikah (female polytheist, pagan, or idolatress)]. There is a report concerning the reason for the revelation of this verse which makes the ruling clearer. Abu Dawood (2051) narrated from ‘Amr ibn Shu’ayb, from his father, from his grandfather, that Marthad ibn Abi Marthad al-Ghanawi used to smuggle prisoners from Makkah. There was in Makkah a prostitute called ‘Anaaq and she had been his friend. He said: I came to the Prophet (peace and blessings of Allaah be upon him) and said: O Messenger of Allaah, should I marry ‘Anaaq? He remained silent and did not answer me. Then the words “and the adulteress –fornicatress, none marries her except an adulterer — fornicater or a Mushrik” were revealed. He called me and recited them to me, and said: Do not marry her. Classed as saheeh by al-Albaani in Saheeh Abi Dawood.

In ‘Awn al-Ma’bood it says:

This indicates that it is not permissible for a man to marry a woman who has openly committed zina. This is indicated by the verse quoted in the hadeeth, because at the end of it, it says: “Such a thing is forbidden to the believers”. This clearly shows that it is haraam. End quote.

Al-Sa’di (may Allaah have mercy on him) said in his commentary on the verse quoted above:

This shows that zina is abhorrent and that it tarnishes the honour of the one who does it in a way that other sins do not. We are told that no woman marries a zaani except a zaaniyah who is like him or a mushrikah who associates others with Allaah and does not believe in the resurrection or reward and punishment, and does not obey the commands of Allaah. The same applies to the zaaniyah: no one marries her but a zaani or a mushrik. “Such a thing is forbidden to the believers” means: it is forbidden for them to marry zaanis or zaaniyahs.

What the verse means is that the one who marries a person, man or woman, who has committed zina and has not repented from that must be either a person who is not adhering to the rulings of Allaah and His Messenger, so he cannot be anything but a mushrik, or he is adhering to the laws of Allaah and His Messenger but he goes ahead with this marriage even though he knows about this zina, in which case the marriage is zina and immorality. If he were truly a believer in Allaah, he would not do that.

This clearly indicates that it is haraam to marry a zaaniyah until she repents, or to marry a zaani until he repents, because the partnership between a man and his wife or a woman and her husband is the closest of partnerships. Allaah says (interpretation of the meaning): “Assemble those who did wrong, together with their companions” [al-Saaffaat 37:22]. Therefore Allaah has forbidden that because of the great evil that it involves. It also implies a lack of protective jealousy and implies that children may attributed to the husband who are not his, the zaani will not be keeping her chaste because he is distracted by someone else. Any one of these would be sufficient for it to be haraam. End quote.

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said something similar, and said that the meaning of the verse is that the one who believes that it is haraam to marry a zaaniyah but still marries her has entered into a haraam marriage contract which he believes is haraam. A haraam contract is like one that does not exist, so it is not permissible for him to be intimate with the woman; in that case the man will be a zaani.

But if he denies that it is haraam to marry a zaaniyah and says that it is permissible, then in this case the man is a mushrik, because he has declared permissible something that Allaah has forbidden and has made himself a lawmaker along with Allaah. This is what we say to a man who gives his daughter in marriage to a zaani.

This (i.e. that it is haraam to marry a zaaniyah) was stated in fatwas issued by Shaykh Muhammad ibn Ibraaheem (may Allaah have mercy on him) and by the scholars of the Standing Committee for Issuing Fatwas, headed by Shaykh Ibn Baaz (may Allaah have mercy on him).

Shaykh al-Islam Ibn Taymiyah said:

Because of the punishment that Allaah has decreed for those who commit zina, He made it haraam for the believers to marry them, as a rebuke to them and because of the sins and bad deeds that they have. … So (Allaah) tells us that no one does that but a zaani or a mushrik.

As for the mushrik, he has no faith that will deter him from committing immoral actions or keeping company with those who do them.

As for the zaani, his immoral nature prompts him to do that even if he is not a mushrik.

Allaah has enjoined us to shun evil and its people so long as they are doing that, and this applies to the zaani.

Allaah has stipulated that men should be chaste and not immoral, as He says (interpretation of the meaning): “All others are lawful, provided you seek (them in marriage) with Mahr (bridal-money given by the husband to his wife at the time of marriage) from your property, desiring chastity, not committing illegal sexual intercourse” [al-Nisa’ 4:24]. This is something that should not be ignored because the Qur’aan has stated it clearly.

As for the prohibition on marrying a zaaniyah, the fuqaha’, such as the companions of Ahmad and others, have discussed it and there are reports concerning it from the salaf. Although the fuqaha’ differed concerning it, those who said it is permissible do not have any reliable evidence. End quote.

He also said (32/110):

Marriage to a zaaniyah is haraam unless she repents, whether it was he or someone else who committed zina with her. This is undoubtedly the correct view, and it is the view of a number of the earlier and later generations, including Ahmad ibn Hanbal and others.

This is what is indicated by the Qur’aan and Sunnah. The most well-known text concerning that is the verse in Soorat al-Noor where Allaah says (interpretation of the meaning):

“The adulterer — fornicator marries not but an adulteress — fornicatress or a Mushrikah; and the adulteress –fornicatress, none marries her except an adulterer — fornicater or a Mushrik [and that means that the man who agrees to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan or idolatress) or a prostitute, then surely, he is either an adulterer — fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer — fornicator, then she is either a prostitute or a Mushrikah (female polytheist, pagan, or idolatress)]. Such a thing is forbidden to the believers (of Islamic Monotheism)”

In the Sunnah, there is the hadeeth of Abu Marthad al-Ghanawi and ‘Anaaq. End quote.

The one who is faced with this problem and who did a marriage contract before repenting has to repent to Allaah and regret what he did, and resolve not to commit this sin again, then he should do the marriage contract again.

This seems to be an issue for many converts to Islam - who may have had sexual relationships prior to converting to Islam.

Does this mean a convert to Islam who has been sexually active prior to converting cannot marry a Muslim who has abstained from sexual relationships until marriage?
I am asking because this topic seems to come up in threads quite often ...

Actually, one of the wonderful beauties of Islam is that when one reverts, they are like a new born baby, as all past sins have been removed. Alhamdulillah. So, it doesn't apply to the sins of reverts that happened prior to reverting.
