Asalamu 3alaykum brothers and sisters,

My name is Marwan,

I work in a London law firm as a trainee solicitor.

The reason or one of the reasons I have joined this forum is because for some time now I have been wanting to give something back to the community and now I feel I am in a position to be able to do so.

If brothers or sisters have any questions regarding criminal law then I am happy to provide advice and if necessary assistance on a pro bono basis.

So feel free to ask away.

I'll log in most evenings to answer any questions or queries you may have.

Although I specialise in criminal law, I will also endevour to answer questions relating to family and immigration if I am familiar with the answer and if I am not I will direct you to a source / body that may be able to assist you.

I have not asked for permission from moderators as to whether or not I can offer this service here but trust that is there is a problem with it they will alert me to it in due course.

We recently got some work done to our other car to get it working properly and pass its MOT, we spent a grand on it and now you cant even drive it down the road, its worse than it was before. The garage isn't willing to do anything about, they say they've spent too much already trying to fix it.

I rang VOSA, they said that the MOT doesn't involve anythin to with the drive of the car, so it is a civil matter and nothing to do with them.

I spoke to a friend who's an accountant he says, you have to file a complaint with the OFT but I don't know what they'll be able to do about it, he also said report them to the tax office so I might be able to screw them over by getting a tax investigation on them.

is there anything else I could do, these guys are muslims by the way so I dont want it to get too personal

I wouldnt recommend reporting them to the tax office...if you have information relating to possible false accounting issues or anything along those lines then getting them in trouble or attempting to would just be a venegeful act against a fellow muslim/human being and we really shouldnt be venegeful people.

The law relating to this matter is the Supply of Goods and Services Act 1982 which requires traders to provide services to a proper standard of workmanship and if a definite completion date or a price has not been fixed then the work must be completed within a reasonable time and for a reasonable charge.

Also, any material used or goods supplied in providing the service must be of satisfactory quality.

The law treats failure to meet these obligations as breach of contract and consumers would be entitled to seek redress, if necessary through the civil courts.

You can therefore take this matter to a small claims court / county court.

Where a summons will be served upon them to attend court to defend their position OR judgement will be made in their absence.

They will be required to show that having worked on the vehicle with the necessary standard of care and skill they were unable to render the car driveable and that the time spent and work completed was proportionate to the sum you had paid in attempting to make it a road worthy vehicle.

If they fail to show this then you stand a good chance of obtaining a judgement in your favour.

They would then be required to do one of a number of things:-

1 - Pay your court and representation costs - though you can represent yourself and the court itself is geared towards people who self rep.

2 - Take steps to complete the work to the necessary standard or/and offer you a sum in compensation.

Proceedings can be started by filling in the relevant form at the local county court you intend to use to bring these proceedings.

I think it costs around £140 to start the ball rolling in terms of Court costs.

I would also like to add that I am not a consumer law specialist and you will need to seek the advice of a specialist in this area to confirm the advice given as being accurate and up to date.

Anyway we'll have to see if its worth going to court over
