I use smileys a lot. The other day, someone sent me this, "there is a longer narration in saheeh al-bukhaari in which `abdullah ibn `abbaas narrates that the prophet `alayhis-solaatu was-salaam said "Whosoever makes tasweer (pictures of faces) will be placed by allah on judgment day into the fire until he can put life into that (tasweer) which he has made."

So what is the opinion of using smileys?

Mufti Husain from Sunniforum says:

The original fatwa was that they were impermissible.
Then a student came across mention of it being permissible if less than a fingertip and answered accordingly.
That became the standard fatwa then.

Thereafter we researched the issue indepth and found that the "less-than-fingertip" mas'alah was regarding the picture being permissible to have near one during salah ie. if less than that size then ok to perform salah with it nearby.
As for creating such an image, the fuqaha have clearly stated that creating even a small image is impermissible.
Allamah Nawawi has mentioned that ijma (consensus) exists on this.
Posting an smiley is creating an image.
This is the formal stance of the Dar al-Ifta at the moment.

As for the last one, it wasn't phrased properly, thus the misunderstanding.
