Punishments?

What should an Islamic State do if they captured a terrorist like Osama Ibn Laden? Should he be handed over to the Americans or whoever the victims are, or should he be given the traditional Sharia punishment for spreading terror and destruction in the land, which, from what I understand, is anything from exile to stoning to crucifixion? Do Sharia punishments change regarding the circumstances, or do they always stay the same?
