    Hey,

    Is it possible to change some parts of Sharia practiced by Saudi Arabia etc according to modern society and advance technology?

    For example;
    Law for rape: you have to several witnesses (correct me if I am wrong), what if someone was raped alone? And why would there be any witnesses? Surely if someone witness rape, they could have stop it? And why would a rapist rape someone in front of a witness? Okay, so you have to have witnesses but can’t scientific evidences be considered as evidence? For example one was raped, the accuser denies sex completely, and DNA evidence shows he did in fact sleep with her. Therefore he is a liar because he denied touching her, which would favour the woman and her claims of rape? And if the court found her to lie (and they always seem to...Why?) And the court can punish both for fornication. Not just the woman....
    Why don’t the Muslims countries use technology?

    Also, age of consent...
    I know the past was a lot different than today’s society for two reasons: 1. our perception on childhood has dramatically changed. 2. The lifespan was short and children then were a lot bigger.
    However, I don’t understand why on earth do Muslims still allow underage marriage? What is wrong with waiting until the child is aged 16 or even 14 but not 6, 7, 8, 9, 10? Why that is in a world already has a bad perception on Islam because of the biased media. but it does not help with I see Islamic group permitting underage marriage to a child then only to see a young child asking for divorce and died from bleeding....which then reaches to western media only for people to say look at what the Islam practice?
    So why don’t Muslim change the law according to advances on technology and our understanding? What harm with this do to Muslim? I see benefits from changes above

    1.It will illustrate that Muslims are not at all bad, and can adapt their religion to development...and present Islam In a better light

    2.Changes can create equality, in rape case both men and women can be punished not just the women.

    3.It will prevent parents from exploiting their own children....what do I mean by this? I mean parents who would sell their own children for money due to poverty. It would also prevent fathers from exploiting the situation i.e. giving his daughter to friend.

    Few changes like this would help Muslims across the world...in my opinion. I dont think the koran says this is not allowed. I personally see nothing wrong with it for the benefit of Justice.

    Rape does not require witnesses - the victim is all that is needed. And the victim isn't to be punished anyway.

    Age of consent is based on culture/societal norms. IIRC, Sharia stance is hit puberty and you are eligible.

    It's not really a case of modernising the law, it's a case of moving back to sharia.

    There is no 'age of consent' as far as I know, people should marry when certain conditions are met, physiological/ psychological and financial.
    There is no reason to not incorporate modern science into sharia'a law like DNA evidence etc. Seeking knowledge and implementing it for good is a compulsion on every Muslim.

    I don't agree with some of the later statements of your posts, I know very little on sharia'a and willing to bet that you know even less as such ignorant on a particular matter shouldn't be allowed to discuss that particular matter and the particulars of that particular matter.. what say you?

    I’m not ignorant if I am seeing this happening in Muslim countries like Saudi Arabia. I also know you need witnesses to rape. And so often women in particular get punished for fornication in Saudi Arabia, Pakistani, Somalia etc.

    I also find it rude; you just dismiss me as ignorant when I see cases in Yemen of children dying from child birth. On child died from bleeding. These stories are not made up. Stop trying to be defensive. I did not attack Islam. I just questioned why many countries don’t set regulation. If you set as age of consent you prevent child abuse. Not every parent looks out for the welfare of children.

    Rape in Islam does require witnesses because the one who claims rape could be lying. In the case of the person who has no witnessed then some of the ulemma state that DNA can be used so the qadhi can use this as evidence against the rapist. But if there is no evidence of the rape then you cannot say to throw the alleged rapist in jail or have him flogged, this would go against maqaasid'ul sharee3ah (reasons for the sharee3ah).

    This is actually a fiqhi issue concerning marrying off one's daughter prior to the age of puberty. Majority of the ulemma do not allow this without consent but some ulemma do (i.e. forced marriages). I know this may sound strange but believe me, once you study the issue it becomes much clearer so don't be so quick to condemn inshaAllah. I'll try to post relevant information inshaAllah concerning it.

    Also, its important to seperate laws of countries which are in essence, kufr laws, and the sharee3ah. The sharee3ah is complete and perfect with much wisdom. To commit isti7laal or istibdaal with it is also kufr akbar. So may Allah cause us to love the sharee3ah and implement it in our daily lives to the best of our ability.

    yeah i must be a troll, it that why i had my account for few years now?

    No one was answering my question at all. I had no idea that these websites were anti - islamic because I got the information from google. I already read these stories from newspaper.

    It took me to post these webisites to get proper answers.

    I came in here to get correct answers. my local iman was not even answering the questions. I came in here with some knowledge. I did not post something that was false. I posted something that was practiced in some countries not all. I came in here to get answers and someone to point me to the right direction. none of the early post did so. Being ignorant means knowing nothing at all, however i came in knowing you needed witnesses. I first poster was wrong. You do need witnesses and i learnt that dna can be used as a witness also.

    And I know the difference between adultery and rape but what I am saying is why do wo/men who claim they were raped get punished for either fornication or adultery? If there is no way they can prove that s/he were raped does not mean they committed fornication or adultery. I just think if they cannot prove s/he was raped then they should leave him/her alone. Claiming to be raped is not a confession of adultery or fornication which what most of these countries do. And they do not use DNA but then again maybe they cannot afford it. Either way this part of the system needs to change. If a predator cannot be punished because they cannot prove it then the victim should not be punished at all.

    Yemen current government wants to change the age of consent due to circumstances above and others but they are facing Islamic group opposing the change and calling Muslims who support this traitors which is not the case. Nothing wrong with waiting for few years until children are mature 15+.

    Thank you I read the link. It is clearer. So these stories from anti Islamic sites are either a lie or the authority in those countries are not following the proper sharia. The witnesses are concerning adultery not rape. Anyways thank you for the link.
