French official threatens to sue social media users who share burkini photos

A French politician has threatened to file a lawsuit against anyone who shares photos or videos of police enforcing a ban on the burkini — the full-body bathing suit, designed for Muslim women, that has suddenly become a symbol of religious and social tensions in France. The statement comes after the widespread circulation of photos showing a Muslim woman removing her clothes in front of four male police officers on a beach in Nice.

Christian Estrosi, president of the Regional Council of Provence-Alpes-Côte d'Azur and deputy mayor of Nice, said in a statement Wednesday that the photos "provoke defamatory remarks and threats" against police agents. He added that legal complaints have already been filed "to prosecute those who spread the photographs of our municipal police officers and those uttering threats against them on social networks."

Nice, Cannes, and several other French cities have recently enacted bans against the burkini, with supporters arguing that the swimwear is not "respectful of good morals and of secularism," and that it poses risks to hygiene and security. Socialist Prime Minister Manuel Valls has said that the burkini represents the "enslavement of women," while former President Nicolas Sarkozy, who announced his 2017 presidential campaign this week, described it as a "provocation" that supports radical Islam.

The argument for the ban rests, ostensibly, on the French principle of laïcité, which aims to keep religion out of the public sphere, and on the basis of gender equality. But critics say the burkini bans only serve to further stigmatize France's Muslim population — the largest in Europe — at a time when tensions are running high following terror attacks in Nice and the northern city of Rouen this summer. The French feminist group Osez le Féminisme! excoriated the bans in a statement released this week, saying they serve only to humiliate Muslim women "on the grounds of sexism and racism," and other rights groups have challenged the bans in court. France's highest administrative court will hear a complaint on Thursday.

The photo that circulated this week was taken in Nice, and first published by The Daily Mail and The Guardian. In the image, taken by a French photographer, four male police officers surround the woman and appear to issue a fine. With the men still standing over her, the woman was photographed removing her long tunic top. The agency that released the pictures in the UK said in a statement to The Guardian that the woman was fined and left the beach, but the office of Nice's mayor denied that she had been forced to remove her clothes, telling AFP that she was only showing the officers that she was wearing a swimsuit under her clothes. Notably, the woman was not wearing a burkini, but a long-sleeved tunic, headscarf, and leggings.

The legal basis for Estrosi's lawsuit threats remains unclear. When reached for comment Wednesday by Numerama, a French tech blog, the mayor's office could not provide a legal explanation for the complaints. As previously reported by Le Monde, French law does not prohibit citizens and media outlets from disseminating photos or videos of police, and officers are not allowed to seize cameras without a judge's order.

"The position of Estrosi is very dangerous because it shows how people in power in France are completely disconnected from reality," says Yasser Louati, a civil rights activist who has been an outspoken critic of French policies perceived to be discriminatory against Muslims. "If citizens cannot denounce unfair practices and the public humiliation of women, then who can?"

Rather than seeking to temper online outcry, Louati says Estrosi should "question the way those policemen behaved, and he should question himself."

"Those pictures were shared because they expressed global outrage," Louati adds. "So yes, I will definitely share them, and if he wants to sue me, be my guest."

    Fascism, anyone?

I find it ironical that so-called secular countries want to regulate social media use.

For example, President Erdogan in Turkey had restricted social media usage and it was an irony that it was social media usage in fact that saved him when he asked people to protest the coup.

China engages in extreme Internet censorship.

Today, a French politician is saying that if you participate in sharing photos of police acting in ways that the global public might be outraged, that you might likely face prosecution. In fact, the mayor in Nice, France has already filed legal complaints to prosecute the "criminals."

    Au revoir, liberté, égalité, fraternité!

It'd be more correct to call France a form of communist state. Similar to that of Stalin's.. France: The republic of Communists, Signature: "Stalin".

we are heading towards a new Era of communism, a new Era where Muslims are the victims. may Allah help us and have the tables turned. In the end, Muslims will be victorious, in death too.

    And Allah knows best.

There goes your freedom out the window.

Talk about straight up hypocrisy. A nun can walk on a beach and nothing would happen to her. A scuba diver could walk on a beach and nothing would happen to him/her.

Also, not to mention the fact that the French have basically just contradicted their values. Napoleon, you know... The guy who led the french revolution establishing this whole liberté, égalité, fraternité nonsense... All that fighting just to get it thrown back into your face only 217 years later.

The Dunyaa is just getting worse and worse by the day. It's not just France. It's everywhere.

The trials faced by Muslims increases every day. The trials faced by Muslims in 2016 is a hundred times worse than the trials faced by Muslims in 2010. Much worse than the trials faced by them even three years ago, in fact.

The Dunyaa will continue to get worse and worse, as Qiyaamah approaches.

The dream bubble of Muslims and Christians/Jews/Atheists/Whatever else "living together in harmony and co-existence" is a figment of their imagination. Something they day-dream about but which has no reality. The Kuffaar do not want to live in "harmony and co-existence" with Muslims, unless those Muslims have discarded every vestige of their Deen and of their Imaan.

That's just the way it is.

Either you become like them, or you aren't like them. Sure, there are exceptions, but ya know, they hate when religion is mentioned.

They wish for us to disbelieve like they have disbelieved, so we'd be alike. Never should we become like them, rather we should distinguish us and disassociate ourselves from them, so they may know that we are Muslims, lest we assimilate to the point that our children won't know the difference between who is a kafir or a Muslim.. And lose our deen.

Anyone can correct me if I said anything wrong.
may Allah protect us, and guide us. Ameen. And Allah knows best.

The cartoon is making fun of the French; I thought the cartoon was appropriate to use since the authorities in France are becoming hysterical over burkinis and now also the usage of social media to show enforcement of the burkini ban.

It's not even really because of any security reasons or because anyone is nervous. That's just an excuse used by them. They just hate Islaam and want to ban it. Plain and simple.

Re: French official threatens to sue social media users who share burkini photos

Am I right in saying that because we are not in a position of authority, that we are being negligent of our obligations towards Allah?

I'm pretty sure I listened to a lecture that said, because we do not read the Qur'an, or have hearts filled with taqwa enough, that we are in such a state

If we read the Quran like we should, and become true believers (i.e. believers full of tawqa/consciousness of Allah) that Allah Himself would grant us authority?

    Idk;.....

Re: French official threatens to sue social media users who share burkini photos

There's a saying: "There's nothing new under the sun."

The governments like France, Russia, America, etc. of today are just like the Fir`own, Haamaan, Namrood, etc. of the past.

Same Fir`ownic tactics going on. Killing, torturing and imprisoning people on the pretext of helping them. Fir`own used to say, "I am only guiding you to the path of righteousness." Said that to Bani Israa'eel who he had enslaved for hundreds of years, killed their sons and had their daughters raped.

    Just like America.

France is acting like Haamaan and the other ministers of Fir`own who said, "These two (i.e. Moosaa and Haaroon عليهما السلام) want to drive you out of your land with their Sihr, and want to put an end to your perfect way of life." In France's case: "These people (Moslems) want to drive you (French people) out of your land (France) with their radical Islamism, and want to put an end to your perfect way of life...(secularism/democracy/nudity/satanism/irreligiousness/atheism, etc)."

And Fir`own, whenever any person would speak out and speak the truth, would threaten him with torture and execution. Any people who dared to speak the truth. He'd threaten to cut off their arms and legs and hang them on the trunk of a tree to die.

America threatens all who speak the truth with imprisonment and torture. As well as bombing their countries. France threatens anyone who speaks the truth about their oppression of Muslims with suing them.

What's going on is just the "Game of the Pharaohs".

Re: French official threatens to sue social media users who share burkini photos

    Greetings and peace be with you Search;

Nice, Cannes, and several other French cities have recently enacted bans against the burkini, with supporters arguing that the swimwear is not "respectful of good morals and of secularism,"
Now it makes you wonder, the picture is of four police officers who are fully clothed, placing a fine on a woman for being fully clothed. So what are good secular morals? is it to look at near naked women? and be offended at women because they are dressed modestly, the world is going crazy.

In the spirit of searching for God,

    Eric

As previously reported by Le Monde, French law does not prohibit citizens ...
The legal basis is simply an open abuse of French man-made law.

It proves again that all communications on the internet should be anonymous by default. Facebook, for example, creates very serious problems by demanding the use of real-world names.
French man-made law is totally powerless against anonymous users.
If we ever want to revert to Divine Law, we should strive to make man-made law powerless.

There are two measures that even this forum could take in order to achieve that:

[1] not to ask email addresses (similar policy as reddit)
[2] additionally expose the website on the tor network (as even facebook does)

On the medium run, it would be advisable to also drop support for the .com domain. It is governed by man-made law. It is, in fact, not really suitable for a site that would seek to be governed by Divine Law. They routinely block access, confiscate domains, and attack site owners just for speech that they do not like, notwithstanding the provisions laid out in the 1969 Brandenburg versus Ohio ruling concerning the freedom of political speech.

Man-made law cannot be trusted. Man-made law is not meant to bring justice. Man-made law is primarily meant to justify injustices. That is why there cannot be free speech unless you are completely anonymous. You should be able to can speak without the threat of violence by the powers that be. They will ignore their own man-made law, if that suits them. They will invent new man-made law to attack your views, if that suits them. There is no way that this could ever go right.

Of course, as servants of the singular God and believers in Divine Law, we are still not allowed to engage in blasphemy, slander, or deception. A site for use by believers will still have no other option than to keep enforcing these provisions, as these requirements are promulgated by the scriptures themselves.

Another measure sorely needed for any site, is to keep distance from the government-controlled riba/interest-infested banking system, which also routinely censors payments and puts site managers under pressure to implement man-made policies.

The believers will indeed have to install a few programs and gradually learn how to use these technologies, but since it liberates their online activities from the arbitrary and obnoxious harassment of man-made law, and brings them under the equitable governance of Divine Law, the believers could actually be interested and willing to do that. The tools are not that hard to use, especially if they are willing to learn. They could even see it as an act of faith.

I personally specialize in the construction, maintenance, and security of bitcoin platforms on the tor network. I am certainly interested in volunteering to help religious sites to get rid of their existing vulnerability to orchestrated pressure and even outright attacks by treacherous man-made law.
